February 09, 2010 Subject: I wish to appeal to you on behalf of JOSEPH LAVE, who is due to be executed on September 13, 2007. My sympathies go out to the families and loved ones of Frederick Banzhaf and Justin Marquart and I agree this was a very tragic event that cannot go unpunished. However, the death penalty—which only serves to create more victims and perpetuate a cycle of violence—is not the right punishment for JOSEPH LAVE. Furthermore Joseph Lave was not the only participant in this crime, yet the other participant received a lighter sentence while Lave was sentenced to die. Lave surrendered to the police once he heard that they were looking for him. During the trial, Timothy Bates, an accomplice to the crime, testified against Lave who was convicted and sentenced to death under the controversial Texas “law of parties. Executing JOSEPH LAVE would violate the right to life as proclaimed in the Universal Declaration of Human Rights and constitute the ultimate cruel, inhuman, and degrading punishment.
